General Terms and Conditions of Sale

 

ARTICLE  1 - APPLICATION OF THE GENERAL CONDITIONS OF SALE

The present general conditions of sale apply to all Internet ticket orders placed with the Musée de la Conserverie Alexis le Gall and the payment portal of the Direction générale des Finances Publiques and are brought to the attention of each purchaser, who accepts them, to enable them to place an order. Consequently, the fact of placing an order implies the buyer's full and unreserved acceptance of these general conditions of sale.

The meaning of the terms used in this document is as follows:

Client : The customer refers to the buyer of an entrance ticket to the Musée de la Conserverie Alexis le Gall connecting to the website of the Musée de la Conserverie Alexis le Gall.

Ordering : The Order refers to any request for goods or services made by the Client to the Musée de la Conserverie Alexis le Gall

Ticket : A ticket is a right of entry with contractual value between the user client and the scientific and technical culture service. It takes the form of a ticket.

Site : The website of the Musée de la Conserverie Alexis le Gall is, among other things, an e-commerce site accessible via the Internet network, the connection costs of which are borne by the customer, accessible free of charge.

These general terms and conditions of sale apply for the duration of the online ticket sale and until a new version is published.

 

ARTICLE  2 - CONTRACTUAL RELATIONS

2.1 - The Mairie de Loctudy, i.e. the Musée de la Conserverie Alexis le Gall, is the sole interlocutor of the client and is responsible for the execution of the obligations arising from the present conditions of sale. The Mairie de Loctudy cannot be held responsible for any damage resulting from force majeure or from the actions of any third party involved in the organisation and running of the visit and the services provided on this occasion.

2.2 - In application of article L 121-20-4 of the Consumer Code, the services provided by the Musée de la Conserverie Alexis le Gall, as cultural leisure services on a specific date or at a specific time, are not subject to the application of the right of withdrawal provided for in articles L 121-20 et seq. of the same Code concerning distance selling.

 

ARTICLE  3 - TICKET PRICES AND PAYMENT

3.1 - Entrance ticket prices are indicated in EURO inclusive of all taxes and have been the subject of a deliberation by the Loctudy Town Council, which makes them compulsory and regulatory. Prices may vary or change at any time. All orders, whatever their origin, are payable in Euro only.

3.2 - All payments must be made on the day of booking. Full and immediate payment is required for all orders placed on the website via the dedicated portal of the Direction Générale des Finances Publiques (DGFiP) PayFip (Titres Payables sur Internet).

 

ARTICLE 4 - VALIDATION OF YOUR ORDER

4.1 - Tickets can be purchased on the website up until the date of arrival at the venue.

The validation of the order implies that the customer accepts the sale as well as the entirety of the present General Conditions of Sale fully and without reserve. The recorded data are authentic and constitute the proof of all the transactions made.

4.2 - The date of validation of the order corresponds to the date of the order and its payment by credit card online (law of 13 March 2000 on electronic signature).

 

ARTICLE 5 - PAYMENT TERMS

Payment by credit card only - Payment by credit card allows you to book your tickets online and immediately and definitively. The cards accepted for payment of an order at the ticket office are cards from the CARTE BLEU/VISA and EUROCARD/MASTERCARD networks. All other means of payment are not accepted. The Mairie de Loctudy, i.e. the Musée de la Conserverie Alexis le Gall, is not responsible for any charges on credit card transactions caused by exchange rate variations or for other reasons.

 

ARTICLE 6 - SECURE PAYMENT AND PERSONAL DATA

6.1 - Payment security - The payment system is provided by the Direction Générale des Finances Publiques (DGFiP) via its dedicated tool PayFip or TIPI-Régie. The total confidentiality of banking information is ensured by the services of the DGFiP and is secured by the SSL (Secure Socket Layer) protocol, which systematically checks the validity of access rights during your payment by bank card and encrypts all exchanges in order to guarantee confidentiality. Consequently, the customer's credit card details never pass through the network and are not collected by the Musée de la Conserverie Alexis le Gall or by its service provider Netao. The payment is made directly to the account holder of the Régisseur de recettes at the service Dépôts de Fonds au Trésor de la DGFiP.

6.2 - Personal data - In accordance with the General Data Protection Regulation (RGPD) of 27 April 2016, the personal information communicated by filling in the online sales form is intended for the sale of admission tickets and access to events organised by the museum centre. The legal basis is the legitimate interest of the online sales service.

The Customer's personal information is intended for the Musée de la Conserverie Alexis le Gall, as well as for its subcontractors involved in the technical and commercial management of the processing of orders (net agencyao). In the absence of consent, personal data may not be communicated to any third party partner or used for any other purpose (e.g. sending information, newsletters).

Personal data is kept for the time necessary to process the Customer's Order and is deleted two years after the date of closure of the last request.

In accordance with the RGPD, the client has the right to access, rectify or delete data concerning him/her, which he/she can exercise by contacting the Data Protection Officer of the Pays de Cornouaille Territory by e-mail: cdg.contact2@cdg29.bzh or by phone 02 98 60 25 65.

It is specified that the Customer is not profiled or subjected to automated decision-making and that his personal data is not hosted or transferred outside the European Union.

If the customer believes that his or her data is being processed in violation of the relevant legal and regulatory obligations, he or she has the right to lodge a complaint with the Commission Nationale Informatique et Libertés (CNIL).

 

 ARTICLE 7 - VALIDITY OF TICKETS PURCHASED ON THE INTERNET

7.1 - Internet tickets are only valid for the period indicated on the ticket. For events, the ticket is valid for the day of the event only. For entry tickets, the validity is one year from the date of issue. These tickets cannot be returned, exchanged or refunded.

7.2 - It is strictly forbidden to reproduce, duplicate or counterfeit an Internet ticket, to make them available for such purposes or to use copies of these documents. Such acts are liable to criminal prosecution, the Mairie de Loctudy, or the Musée de la Conserverie Alexis le Gall, would be entitled to claim damages from the offenders by virtue of the loss suffered.

7.3  - The Mairie de Loctudy, or the Musée de la Conserverie Alexis le Gall, cannot be held responsible in the event of loss or theft of the ticket. Under no circumstances will a duplicate ticket be issued.

7.4 - In the event of cancellation of the event for which the ticket was purchased, due to the Mairie de Loctudy, or the Musée de la Conserverie Alexis le Gall, and on the decision to proceed with a refund, except in the case of postponement of the said event to a later date, the customer may request a refund by sending a written request on which the postal and telephone details of the applicant are given, accompanied by a bank details statement (RIB) and the tickets concerned, addressed to : Mairie de Loctudy, Place des Anciens Combattants, 29 750 Loctudy.

If the Museum is closed on the day of the visit, the admission ticket cannot be refunded. It remains valid for the period of validity shown on the ticket, i.e. one year from the date of issue. No refunds or exchanges will be made, so it is up to the customer to plan their visit in advance.

 

ARTICLE 8 - PRESENTATION OF TICKETS PURCHASED ON THE INTERNET

8.1  - It is compulsory to present the tickets purchased on the website at the cash desk on the day of the visit. The Mairie de Loctudy, or the Musée de la Conserverie Alexis le Gall, reserves the right to refuse entry to the Musée de la Conserverie Alexis le Gall if tickets are not presented.

8.2  - Tickets can be presented digitally (electronic, screen, etc.) or printed (the customer must ensure that printed tickets have good print quality to be authenticated).

8.3  - Partially printed, soiled, damaged or illegible documents will not be accepted and will be considered invalid. In the event of poor quality, the customer must reprint their internet ticket(s), the written information and barcode must be clearly legible. The Mairie de Loctudy, i.e. the Musée de la Conserverie Alexis le Gall, accepts no responsibility for any anomalies that may occur during the printing of the tickets by the customer and will not be able to print the tickets for the customer under any circumstances.

8.4  - Each printed Internet ticket has a barcode allowing access to only one customer. It is not possible to be admitted to the Musée de la Conserverie Alexis le Gall more than once with the same Internet ticket. Only the first person to present the Internet ticket will be admitted, this person being presumed to be the legitimate ticket holder. Internet tickets are neither exchangeable nor refundable.

The ticket sales referred to herein are governed by French law and are subject to the jurisdiction of the courts of Rennes.
